Terms and Conditions

These Terms and Conditions apply to your use of the Sacrebleu ! Caneles & Co website and/or products. By visiting our website and/or purchasing one of our products, you are agreeing to the following terms.

DEFINITIONS

In these Terms and Conditions:
“us”, “we”, “our”, “the service” or “Sacrebleu ! Caneles & Co ” individually and collectively refers to the business, Sacrebleu ! Caneles & Co

”Customer” or “you” refers to any person who visits, enquires and/or purchases from Sacrebleu ! Caneles & Co

“The site” refers to Sacrebleu ! Caneles & Co website.

“Coupon” means a digital ticket or document that is:
a. worth a certain monetary value,
b. can be exchanged for a financial discount or rebate, and
c. which may be spent only for specific reasons or on specific goods or services.<br

All pricing is in Australian dollars (AUD$)

ORDERS POLICY

1. Ordering
Online orders can be placed at anytime through the site. Orders placed via phone call, text, sms, Instagram DM, Facebook messenger are subject to Sacrebleu ! Caneles & Co terms and conditions. Please pay extra attention to delivery zones for items selected. If items flagged as ‘Sydney Local’ only are added to the order Australia Wide delivery, we reserve the right to cancel the order and proceed to refund. 

2. Payment
All orders require full payment at the time of ordering. Sacrebleu ! Caneles & Co accepts Visa, MasterCard, AMEX and Paypal. Payments are completed online via our secure payment gateway.

3. Notifications
By using the platform, you agree to receive Notifications and other communications from Sacrebleu ! Caneles & Co at any date or time. The Sacrebleu ! Caneles & Co will communicate with you by sending emails, text messages and/or smartphone notifications. Sacrebleu ! Caneles & Co notifications are used to inform you of new offers, order status updates, account changes, delivery status and other important information relating to your account.

4. Order Cancellations
Cancellations will be accepted up to 7 days prior to the scheduled shipping, delivery or pick up time only. No refunds will be provided for orders that are cancelled with less than 7 days notice due to costs incurred by the initiation of an order. This includes cancellation for change of mind, act’s of god and other unforeseeable events.
All cancellation refunds are subject to a 15% fee to cover costs incurred by the initiation of an order. All order cancellations must be submitted in writing to contact@sacrebleu.com.au
Sacrebleu ! Caneles & Co reserves the right to cancel an order at any time. If your order is cancelled we will contact you immediately by either phone call, SMS, email, social medial (Facebook or Instagram) to notify you of the order cancellation.

5. Order Changes
Changes are permissible to an order up to 7 days prior to the scheduled pick up time. Sacrebleu ! Caneles & Co cannot guarantee that the alternative requested will be available and will reserve the right to offer suitable replacement. All changes must be submitted in writing to contact@sacrebleu.com.au
Sacrebleu ! Caneles & Co reserves the right to change an order at any time. If your order is cancelled we will contact you immediately by either phone call, SMS, email or social medial (Facebook or Instagram) to notify you of the order change.

6. Articles for rent
Customers can rent some material from Sacrebleu! such as cake stands or other items. Full payment for the rental and refundable deposit must be made at the time of the order. Rented material will be delivered at the same time as the order. In case an item is received with damages by the customer, an email needs to be sent within the hour following the delivery and include the following details: delivery ID , proof of damages (high res images showing at least 2 different angles, explanation of the situation) Upon return of the rented item in good condition, Sacrebleu ! Caneles & Co will refund the deposit. Refundable deposit will be done with bank transfer or credit card within 48hours of the return of the rented item. Good condition of the returned item will be a the discretionary of Sacrebleu ! Caneles & Co For any damage made to the rented material or in the event the material is not returned within 7 days after the agreed date, Sacrebleu ! Caneles & Co reserves the right to retain part or the totality of the deposit.

7. Refunds
All our customers are protected by Australian Consumer Guarantees – please refer to this link for your rights as a consumer . All Sacrebleu ! Caneles & Co Terms & Conditions are in accordance with the Australian consumer legislation.
You are entitled to a repair, replacement or in some cases, a refund only when a product is not of acceptable quality, as outlined by the Australian Consumer Legislation referred to above. Sacrebleu ! Caneles & Co is not responsible for damage that may occur to an order after pickup or delivery. Sacrebleu ! Caneles & Co takes all care and effort to ensure the integrity and quality of all products. All orders that leave our kitchen are created with the highest care possible. Once an order is received by a customer from the Sacrebleu ! Caneles & Co premises, we relinquish all responsibility for an order’s condition and appearance. We no longer have control over the appearance of the product. We provide all customers with care and handling instructions through our online store and verbally. If an order is damaged during transit or anywhere that is not on the Sacrebleu ! Caneles & Co premises, it is at the discretion of Sacrebleu ! Caneles & Co to remedy accidental customer damage. If an order is not collected by a customer, Sacrebleu ! Caneles & Co is unable to provide a refund for the order. All refund request must be submitted in writing to contact@sacrebleu.com.au with a full description of the incident, high resolution images (multiple view points, at least 2). Additional documents may be required for full assessment of the situation.

8. Customer Dissatisfaction
Sacrebleu ! Caneles & Co is committed to quality and exceptional customer service. If a customer is dissatisfied with our products or service, we encourage customers to call 0421 089 114 or email contact@sacrebleu.com.au should they wish to provide us with feedback. Complaints will be effectively assessed and responded to ASAP.

9. Artistic License Disclaimer
All our products are handmade and unique, so no two are ever the same. None of our products will ever replicate or look identically, like another photo. Sacrebleu ! Caneles & Co is not able to provide a refund for a product that does not look identically like another photo.

            10. Delivery policy Local Sydney
Sacrebleu ! Caneles & Co currently doesn’t offer a delivery service through a courier. We can arrange for Uber deliver at customer’s cost and cannot guarantee the condition of the order upon reception. We cannot guarantee delivery by the chosen time-slot due to factors outside of control, such as traffic. Payment for all deliveries must be made in full online before the order leaves our kitchen. Drivers or couriers will not be able to wait at delivery locations if there is no authorised person to receive the order. Customers must ensure a person is available to receive a delivery during the time-slot chosen. In the event where the courier arrives at a location and is not able to deliver the product due to recipient absence, the courier will try to get in touch through contact details left during ordering process (call, SMS, Email, social media). If no answer is received, the courier or driver will not be able to stay and wait. It will be at the courier or driver discretion to either leave at address of delivery and send a photo to the contact details given during ordering process, or will return the product to Sacrebleu ! Caneles & Co premises, at the customer’s expense. Once a product is delivered in person or left at the delivery address, Sacrebleu ! Caneles & Co releases all responsibility for the condition of the product. Sacrebleu ! Caneles & Co is unable to provide a refund for the order. Sacrebleu ! Caneles & Co will not be held responsible for the condition of an order once the order has been received by the venue. At times, Sacrebleu ! Caneles & Co may offer free delivery when order reaches a certain value (excluding delivery fee) which remains at Sacrebleu! Caneles & Co discretion and may change at any time and without notice. 

          11. Delivery Zones 

To arrange for a quote, please contact us contact@sacrebleu.com.au 

For all items ‘Australia Wide delivery’: items will be shipped via Australia Post or other best alternative. If no mean of delivery can be found by Sacrebleu ! Canelés & Co will advise the consumer and proceed to a refund. 

         12. Pick up (Local sydney only)

During check out, customers can choose from local pick up.

Deliveries will be completed between 11am and closing time on the day stated on the order and we will do our absolute best to make the goods available within this time frame. If for any reason we were under the obligation to make the goods available outside this time frame, we will advise by all means of communications communicated at moment of order placement (such as but not limited to email, phone, SMS, instagram private messenger, facebook messenger). Sacrebleu ! Caneles & Co is unable to provide a refund for the order If the order cannot be picked up.

13. Shipping Australia Wide 

During check out, customers can choose for a limited number of items the possibility to have Australia Wide delivery. If items flagged as ‘Sydney Local’ are added to the order Australia Wide delivery, we reserve the right to cancel the order and proceed to refund. 

These orders will be delivered through Australia post and flat shipping costs added at checkout. We may need to re-adjust the shipping costs and will advise by all means of communications left at moment of order placement and / or order shipment (such as but not limited to email, phone, SMS, instagram private messenger, facebook messenger). If new shipping costs are not approved and paid within indicated timeframe, Sacrebleu ! Caneles and co will proceed to refund and cancel the order. 

We will do our absolute best to deliver within the time frame requested at the time of order and if for any reason we were under the obligation to deliver outside this time frame, we will advise by all means of communications left at moment of order placement and / or order shipment (such as but not limited to email, phone, SMS, instagram private messenger, facebook messenger). We cannot guarantee delivery by the chosen day due to factors outside of control, such as Australia Post or shipping provider conditions of operation at the time of the shipment. Sacrebleu ! Caneles & Co will always endeavor to choose a delivery service that will guarantee a customer’s order arrives in the best possible condition, as intended by Sacrebleu ! Caneles & Co. We will send tracking details and estimated ETA upon shipment as per information from our shipment provider. Once a product is transferred to Australia Post or any courrier service provider, Sacrebleu ! Caneles & Co releases all responsibility for the condition of the product. Customers must ensure a person is available to receive the delivery on the chosen day. In the event where the shipment arrives at a location and is not able to deliver the product due to recipient absence, the driver will not be able to stay and wait. It will be at the driver discretion to leave at address of delivery following instructions given at the time of order or in a location deemed safe.  Sacrebleu ! Caneles & Co is unable to provide a refund for the order. Sacrebleu ! Caneles & Co will not be held responsible for the condition of an order once the order has been received. In case of dissatisfaction, an email needs to be sent at contact@sacrebleu.com.auwithin 24hours following the delivery and include the following details : delivery ID , proof of damages (high res images showing at least 2 different angles, explanation of the situation. For any questions, please contact us contact@sacrebleu.com.au

Coupons

Where the Site delivers ‘Coupons’, you accept that the following applies:
a. Coupons are deemed to be redeemed at the point and time of being issued

b. Coupon Terms & Conditions of use are set by Sacrebleu ! Caneles & Co

c. Period of Coupon validity is determined by Sacrebleu ! Caneles & Co. Any limitation on the number of coupons per customer is determined by Sacrebleu ! Caneles & Co

GOOD FOOD & WINE (GFW) exclusive offer is limited to recipients of GFW and limited to one order per email address. You may be required to show proof of reception of the GFW email containing the offer. Failing to provide will see usage the coupon declined. Offer is valid on all items apart from Canelés, as a stand-alone item or in a bundle. Coupon has to be entered at check-out to be applied. Discount is applicable on items excluding delivery fees. Cannot be used in conjunction with other coupons. All terms & conditions apply.

THANK YOU Coupon exclusive offer is limited to email address left by person who left review on Sacrebleu! Canelés & Co website and limited to one order per email address. Privacy

You agree to be bound by Sacrebleu ! Caneles & Co Privacy Policy, which is incorporated into these Terms and Conditions. The Privacy Policy can be read by referring to the ‘Privacy Policy’ hyperlink on the Site.

Termination of access

We may terminate your access to any part of, or all of the site at any time for any reason without notice. We reserve the right to cease operating the whole part of the site at any time.

Changes to Terms and Conditions

We reserve the right to change these Terms and Conditions at any time by notifying users of the existence of revised Terms and Conditions through the Site. By continuing to access the Site, you agree to be bound by the amended Terms and Conditions.

Liability

Whilst reasonable care has been taken to ensure the information provided through the site is accurate and the opinions given are fair and reasonable, neither we nor any of our employees, to the fullest extent permitted by law, will in any way be responsible for errors or misstatements or be liable whether in contract, tort (including negligence) or otherwise for any loss or damage however caused (whether direct, indirect, consequential, special, or loss of profits).
Customers will indemnify us against any loss (including consequential loss) suffered by us in relation to any third party claim or cause of action arising directly or indirectly out of your use of the site or a breach of these Terms and Conditions.

Proprietary rights in content and confidentiality

All intellectual property, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files is the property of Sacrebleu ! Caneles & Co and may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without our prior written consent, except that you may print, or download to your hard drive, extracts from the Site only for your own use.

Waiver

If at any time we do not enforce any of these Terms and Conditions or grant you time or other indulgence, we will not be construed as having waived that term or our rights to later enforce that or any other Term or Condition.

Severability

If any portion of these Terms and Conditions is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.

Governing Law

These Terms of Use will be governed by Australian law and you agree to submit to the exclusive jurisdiction of the Australian Courts.
